Parking   Garbage Removal

There is no parking in a "No Parking" Zone. No vehicle may block a garbage dumpster. Your vehicle is subject to towing if your vehicle prohibits garbage removal. Any such vehicle may be towed or removed by the council at the expense and sole risk of the unit owner. The council shall have no responsibility for damage done to any vehicle removed.

Owner/Renter/Guest parking: There is no parking on the grass (the resident is responsible for informing your guests that parking on the grass is strictly prohibited) at any time for any reason (including, but not limited to, overnight parking, partial parking on grass, washing car on the lawn). Any damage to the lawn will be at the owner's expense (this is in addition to the fine), such as, ruts from parking or driving on the lawn.

Parking in a manner that blocks a sidewalk, driveway, and/or other owner's garage is not permitted.

Any vehicle inoperable, without tags or current tags located on the community property, but not housed in a garage, will be considered abandoned and towed away at the owner's expense.

Owners/Residents are allowed the parking space in their garage and behind their garage. If applicable, please adhere to reserved unit parking signs. Violators may be towed.

Please understand that the Board is working towards conformity which will increase and/or maintain the value of the entire community.

Window drapery backing (which is visible from outside) shall be "OFF WHITE" in color and shall be subject to prior Board approval.

Any and all approved shutters and/or awnings shall be black.

Effective April 1, 2016, all new or replaced screen or storm doors shall be white. All trim around windows shall also be white.


No items shall be attached to the structure of the building/roof (including, but not limited to, satellite dishes AND cables of any kind). If damage occurs to any part of the building as a result of failure to comply with this rule, repairs will be made by a Board approved contractor, and all costs will be the responsibility of the Homeowner (in addition to the fine). Permission must be submitted to the Board prior to placement of the satellite dish. (See Exterior Modification Application.)

Holiday decorations that will not damage the guttering may be hung without written approval of the Board. However, any damage that occurs to the guttering as a result of the hanging of said decorations is the responsibility of the Homeowner/Resident. Repairs will be made by a Board approved contractor and all costs will be the responsibility of the Homeowner.

The exterior of the buildings shall not be altered in any way without written approval from the Board. Any repairs of damages incurred from altering the appearance of the exterior of the building shall be made by a Board approved contractor and all costs will be the responsibility of the Homeowner (including, but not limited to, altering the garage into extra living space).
Please complete, and submit to the Board, an Exterior Modification Application for any and all requests pertaining to any part of the exterior of the buildings and/or landscaping on the common or limited common areas.

All pets shall be controlled so as not to create a nuisance (example: barking, fleas, smell, waste, etc.). Dog owners are responsible for excessive or continuous barking of their pets (Jefferson County Ordinance 91.004).

All pets must be licensed and have the required shots as per Jefferson County Ordinance. Farm animals or rodents are NOT allowed as pets.

No pet may be maintained in a unit if it becomes a nuisance. Actions which will constitute a nuisance include, but are not limited to, an attack by the pet on a person, more than one unprovoked attack on other animals, abnormal or unreasonable crying, barking or scratching.

Dog owners (or other pets, if applicable) are to have in their possession a suitable device for picking up and disposing of dog feces (Jefferson County Ordinance 91.011) ) and are required to make proper disposal of said dog (or other pet) waste. This includes all areas owned by the Association, including the "woods".

Dogs are not permitted to be off a leash if outside a fenced area of property. (Jefferson County Ordinance 91.051).

Doghouses or other structures used, or intended for the housing or keeping of animals, may not be constructed or placed within the community.

Any property damage from a pet (such as, digging, damage to shrubs, urine spots which kill grass, etc.) will not be permitted. Replacement and repairs will be made by the Board approved lawn company, and the pet owner will be held responsible for the costs of the replacement and/or repair (in addition to the fine).

Common Areas and Flowerbeds

No garbage containers or bags of garbage of any type shall be outside a residence, including the driveway, walkway or grass.

There shall be no firewood pile outside the building. There shall be no burning of wood, except in your fireplace. Ashes may only be disposed of in secured bags and placed in a dumpster.

Nothing shall be done or kept in any of the common areas that will increase the rate of insurance for the buildings. No owner/resident shall permit anything to be done or kept in the unit or on the common areas which will result in the cancellation of insurance on the buildings. In the event these guidelines are unclear or ambiguous, the master deed and by-laws, and/or any applicable city/county ordinances shall be controlling.

Nothing (this includes, but is not limited to; pots, boxes, bags, other types of storage items, and ladders) shall be stored on the common elements without the prior written approval of the Board of Directors except as expressly permitted under the terms of the condominium by-laws. These items cannot sit outside overnight. No clothing, sheets, blankets, or items of any kind shall be hung out or exposed on any part of the common or limited common elements.

Outside clotheslines shall not be placed on any outside area.

No sign for advertising, except "for sale/rent" and garage sale advertising signs shall be displayed.

Owner/Resident must receive written approval from the Board to alter the flowerbed area outside their unit. The Board has allowed each unit owner/resident the opportunity to personally care for their flowerbed, which is limited to planting flowers, very small bushes, weeding, trimming bushes and laying mulch. NO ornamental items or plants in pots are allowed unless approved by the Board.

NO vegetable gardens or plants of any kind are permitted.

Removal of trees and/or large shrubs must receive written permission from the Board of Directors. An insured contractor will be required to remove all large shrubs and/or trees. There is absolutely no planting of trees. All mulch MUST BE BLACK IN COLOR.

The Board maintains the authorization to override the caring of the flowerbeds at any or all units. The Board maintains the authorization to trim or remove any shrubs, trees and/or other plants in any of the common or limited common ground areas, including the flowerbeds outside any unit, overriding the individual owner/resident's wishes or preference. The flowerbeds are a common ground area.


General General

Noise is in violation if noise is audible between units from the hours of 9:30 p.m. to 8:00 a.m. Sunday through Thursday and 11:30 p.m. and 9:00 a.m. Friday and Saturday. Excessive noise at any time, as measured by the owner/resident's inability to enjoy the use of their residence, is a violation subject to the fee structure outlined below.

Power tools or other equipment that creates significant noise shall not be used between 9:00 p.m. and 9:00 a.m. of the following day, Sunday through Thursday, and 9:30 p.m. and 9:00 a.m. on Friday and Saturday.

Homeowners/Residents shall not at any time, bring into or keep in their homes, any flammable, combustible, or explosive fluids, material, or chemicals, except for household use and in household quantities.

A minimum temperature of 55 degrees Fahrenheit will be maintained in all homes during the cold winter months between Oct. 15 and April 15 to prevent potential damage to plumbing through freezing of the pipes.

No noxious or offensive trade or activity shall be conducted on any lot within the community. Nor shall anything be done which may be or become an annoyance or nuisance to the neighbors/neighborhood.

Homeowners are responsible for maintaining their chimneys, decks**, windows, doors (including sliding doors), and interior of their unit. Please read the Governing Documents for a detailed description of homeowner's responsibilities.

**All decks built by homeowners after the original date of construction, are the responsibility of homeowners.

When you pay your homeowner dues late, you will incur late fees. The policy has been simplified so that all late fees will be $35 per month. These fees will be automatically attached to your account.

Liens:  Once a homeowner has a minimum of $360.00 in late dues and additional fees, a lien will be placed on the property. The homeowner is liable for all reasonable legal fees, attorney fees, fines, late fees, and administrative fees.

Foreclosures:   Once a homeowner has a minimum of $1,200.00 in late dues and additional fees, foreclosure procedures will begin on the property. The homeowner is liable for all reasonable legal fees, attorney fees, fines, late fees, and administrative fees.


Penalties for Rules and Regulations Violations Penalties for Rules and Regulations Violations   Fining System

The Board of Directors would like to remind the Homeowners/Residents of the responsibility they have to their neighbors and friends to be continuously aware of actions that might be offensive to others. Homeowners/Residents are encouraged to report any rule violations observed in the community to our management company.

Penalties for Rules and Regulations Violations continued:

Complaints:   A complaint regarding a violation must be registered with the management company by phone, email or mail to Cornerstone Property Management.

Penalties:   (Please be aware that violation fines will be added to your homeowner balance and will incur additional late fees of $25.00 if not paid.)

Step 1:   written warning letter and notice that a $25.00 fine will be imposed if not in compliance within 14 days from the date of this letter.

Step 2:   $25.00 fine and a written warning letter that a $50.00 fine will be imposed if not in compliance within 14 days of this letter.

Step 3:   $50.00 fine and a written warning letter that a $100.00 fine will be imposed if not in compliance within 14 days from the date of this letter.

Step 4:   $100.00 fine and a written warning letter that a $200.00 fine will be imposed if not in compliance within 14 days from the date of this letter.

Step 5:   $200.00 fine imposed and letter notifying the homeowner/resident that he/she has 15 days from the date of this letter to comply and pay all fines, or a lien will be placed on the property and court action will be taken up to and including foreclosure. The homeowner is liable for all reasonable legal fees, attorney fees, fines, late fees, and administrative fees.

Step 6:   A lien will be placed on the property and court action will be taken up to and including foreclosure. The homeowner is liable for all reasonable legal fees, attorney fees, fines, late fees, and administrative fees.

Repeat violations of the same type by a homeowner will initiate the penalty process at Step 2.

The Board may take fining action on any additional broken rules/regulations as stated in the by-laws.

If the Board incurs attorney fees or court costs in enforcing any provision of these Rules and Regulations, then the owner in violation shall be further responsible for such attorney fees and costs which may be collected, including but not limited to becoming a lien on the property of the violator, suit to obtain judgment or foreclosure, or both.


Appeal Process:   A homeowner/resident receiving a Violation Penalty who believes no violation occurred, may submit a written explanation to the Board or managing agent. The written explanation must be submitted within seven (7) days of the date on the Violation Penalty Notice. The owner/resident will be given an opportunity to present their appeal to the Board at the Board's next scheduled meeting. The Board will make a decision during a closed session portion of the meeting. No fine will be imposed or corrective action taken until after the appeal to the Board at that Board meeting.


Clarifications

Owners are responsible for tenants, guests and invitees.

Wherever, in the above Rules & Regulations, reference is made to "owner" or "homeowner", such term shall apply to the owner of any unit within Shaker Farms Condominiums, to such unit owner's family, tenants (whether or not in residence, employees, visitors and any guests, invitees). Wherever in these regulations reference is made to the "Board", such reference shall include the Board of Directors for Shaker Farms Condominiums and the managing agent for Shaker Farms Condominiums when the managing agent is acting on behalf of the Board.
